Apart from allowing newly admitted tertiary students to register their gender, the High Court has also decided to allow current tertiary students to change their name and gender as mentioned earlier in their academic records.
The bench of Justice Gautam Patel and Justice Neela Gokhale also mentioned while giving the above order that it takes time to realize one’s identity as a man or woman.
Former students of the Tata Institute of Sociology (TISS) had petitioned to change his name and gender in education records. The court gave this order while passing judgment on it.
In 2013, the petitioner had completed her post graduation from the institute as a girl. In 2015, the petitioner assumed another name. He also revealed his identity to a third party. The petitioner now wants to study law and sought an order to the institution to provide fresh educational records with his new name and changed gender. But due to no response from the organization, the petitioners approached the High Court.
